While driving, our client sustained severe injuries when he was hit by a water delivery truck. As the truck driver was approaching an intersection, he was looking at a road map instead of paying attention to the road, which he admitted to police.
We sued and soon thereafter moved for summary judgment, which is a motion filed when it can be proven to the court that there are no issues of fact warranting a trial. Prevailing on such a motion can expedite recovery.
We prevailed on our motion and were awarded summary judgment on the issue of liability. The court determined that the accident was the truck driver’s fault, leaving only the amount of damages to be awarded to our client to be determined.
After prevailing on liability, we settled the matter for approximately one million dollars ($1,000,000.00). Thereafter, in order to further protect our client, we “structured” the settlement so that our client received a portion of the settlement up front, and the balance was invested in a guaranteed annuity to ensure that our client will receive a guaranteed income for the rest of his life!
Our ability to prove liability allowed us to file a summary judgment motion very quickly, and we prevailed on it in several months. The entire case was completed expeditiously – speedy as these cases go.
