Follow Up On AG Sessions v California

By Hubert Plummer posted 03-28-2018 10:37 AM

An update on the Sanctuary City lawsuit against California by Attorney General Sessions that we reported on earlier this month.[i]  AG Sessions sued the State of California challenging three new laws the State passed as unconstitutional interferences in the Federal Government’s enforcement of immigration laws.

Now the Associated Press is reporting that the Orange County Board of Supervisors has voted to condemn the California’s sanctuary laws and join the Justice Department’s lawsuit against the State.[ii]

What form this participation will take is unclear.  Since our last report on this case, nineteen parties have requested permission to file Amicus briefs.[iii]  Those include the states of Texas, Alabama, Arkansas, Florida, Georgia, Indiana, Kansas, Louisiana, Michigan, Missouri, Nebraska, Nevada, Ohio, Oklahoma, South Carolina and West Virginia, as well as the Governors of Mississippi and Maine, and the American Center for Law and Justice.

This is clearly gearing up to be a big case and we will keep an eye on it.

[iii] Amicus briefs are legal papers filed by non-parties to the case to supply the court with additional information they believe is important to the case and to present an argument or position that the parties to the case may not cover or have considered.
